Trust Administration
​
Trust administration is the processes by which assets owned by a decedent’s trust are transferred to the trust beneficiaries upon the decedent’s death. We represent both trustees and beneficiaries, and specialize in representing trustees dealing with difficult beneficiaries, or beneficiaries who are concerned that their trustee may not be acting appropriately. If you have just become the successor trustee of a trust, it is important to understand what exactly your fiduciary responsibilities are. We can help walk you through that process, offer financial advice and help prepare a fiduciary accounting.
Estate Planning

Estate planning has always been the foundation of our practice. From simple wills to complex trusts, we have drafted hundreds of estate plans for individuals and families throughout California. We draft trusts, wills, powers of attorneys, advance health care directives, trust transfer deeds, and property assignments for our clients. An estate plan is a set of documents that ensures that your estate passes to your intended beneficiaries at the time of your death. Additionally, you can nominate the person who will administer your estate at your death. In addition, you can nominate someone to become your Power of Attorney to make medical and financial decisions for you in the event you become incapacitated. If you have minor children, an estate plan will also allow you to establish a guardian for young children. Having an estate plan is also designed to avoid or reduce estate taxes which can be extremely high depending on the value of your estate.
Elder Abuse

Elder abuse is the physical abuse or neglect of a person over the age of sixty-five or a dependent adult.Financial elder abuse – the wrongful taking or retention of the property of an elder – has become a societal epidemic. Elder abuse is most often committed by a family member or caregiver; however, some of the most financially devastating abuse is committed by professional con men posing as trustees or financial advisors. t is not uncommon for the victim of elder abuse to be reluctant to talk about the abuse because they are ashamed of being victimized or they don’t want to report a child to the police (Elder abuse is most often committed by a child against a parent.) Elder abuse is both a civil offense and a crime under California Penal Code Section 368.
Conservatorships

If a loved one becomes incapacitated, can no longer make financial decisions, or is vulnerable to undue influence or elder abuse, a conservatorship proceeding is often the best option. We can help you establish (or oppose) a conservatorship to preserve your family’s well-being.
A conservatorship is a court proceeding designed to protect elders or dependent adults who may be unable to care for themselves or to resist fraud or undue influence. In a typical case, a family member or friend (called the “petitioner” ) files a petition with the court in which he or she asks to be named the “conservator” for the elder, who is referred to as the “proposed conservatee”. A “conservator of the person” is a person granted authority by the court to make decisions regarding the personal care of the conservatee. The conservator of the person typically makes decisions about the conservatee’s medical affairs, living arrangements, and social life. A “conservator of the estate” is granted the authority to make financial decisions for the elder. We have represented clients in temporary conservatorships, general conservatorships, contested conservatorships, and removal of conservators.
Trust Litigation

Our trust litigation attorneys have handled many lawsuits covering all aspects of trust litigation, including trust contests, breach of fiduciary duty, disputed trust accountings, trustee removal cases, petitions for instructions, and disputes between co-trustees.
We represent trustees accused of wrongdoing, as well as beneficiaries when their trustee is dishonest, incompetent, or sometimes just refuses to act. We typically try to work things out with the other side before filing a petition in probate court, but by the time these disputes reach our office the litigation is often inevitable. If a court case is necessary, our trust litigation attorneys draft the court filings, appear in court on your behalf, conduct discovery, appear at mediation, take depositions, and try the case.
